We split 4 yrs ago, she moved 200 miles away and stayed in boise. I have a fiance, we own our house, and have 2 more kids. My ex is taking my daughter, whom I’ve had consistant visitation with for the last 6 months (and have made all the efforts to keep visitation regularly in the past 4 years), to seattle to live with her mother(w/ whom she doesn’t get along). She’s moved 7 times since we split (8 after she moves to seattle friday) and my child has missed many days of school, many dr. appointments, therapy sessions, visitations with me, etc. My fiance is the one who has taken her to 90% of her dr. appts. In 4 years, my ex brought my daughter to me 4 times(2 were for surgeries) & pickedup my daughter from here 1 time. Our arrangements are supposed to be I get custody 2 wknds 1 month, 3 the next, and holidays and summer are split. The divorce papers don’t include moving out of state but custody is to remain the same. Is there anything I can do? Hold her in contempt? Could i get custody?

Get an attorney immediately! She has to abide by the court papers.

  1. You can tell the court visitation laws are being violoated, she is in contempt. You can continue to do this each time she denies you the right to see them. Keep track of each effort you have made and eventually you could get custody of your children.

    And, instead of whining here why haven’t you took all that info and filed to get full custody. Sounds like a classic unfit mother to me.

  4. i’m a single father,why u never filed for joint or even full custody?u should’ve been got the courts involved!

  5. Run – don’t walk – to an attorney. She is in contempt of the visitation laws and you could easily file for full custody.

    Acquire an attorney now, and prove that you are a fit father.

    Your ex partner cannot deny your custody rights, because you are a parent too. Fight for your rights legally.
